Boardmembers should take reserve planning seriously and, if they have a current (credible!) Reserve Study, they should adhere to its recommended Funding Plan. Likewise, Boards without a Reserve Study should “bite the bullet” and get one done by a credentialed Reserve Specialist. If the Board discovers the Association is well-funded, by all means spread the good news among the homeowners and the local real estate agents. If the Board learns their Association-governed community is underfunded, they would be wise to take steps to start reversing the process!

It is not surprising that a roof fails. From the moment the last shingle on a new Association is nailed into place, that shingle (along with all the other Association assets) starts a slow, steady process of deterioration that will culminate in the roof reaching the end of its Useful Life. The anticipated Useful Life (measured in years) of various roofing types is well-documented and none are rated to last “forever”.

In California there is no statutory requirement for associations to fund their reserves at any particular threshold; however, the state does require that associations conduct a full and complete reserve study with a site inspection of components once every three years and update the reserve study annually. While you’re at it, your board may ask you to compare their association with the average community in California.

One question we are frequently asked by managers and board members pursuing assessment collection is “what are the pros and cons of judicial versus non-judicial foreclosure?” Apparently various non-attorney collection firms frequently recommend non-judicial foreclosure (the only type of foreclosure a non-lawyer can perform) to associations as the preferred foreclosure process when pursuing assessment collection actions.
