CAN AIRBNB LIVE WITHIN THE RULES OF AN HOA?

Three things to consider before you rent your house out for the weekend.

Guests of these rentals love the convenience and money-saving opportunities that come with staying in a home and avoiding a hotel. Plus, Orange County has year-round tourists with close proximity to the gorgeous beaches, envious surfing, fun amusement parks, and our incredible weather.

Homeowner-landlords are flocking to AirBnB as a way to generate extra income while they’re away, or because they get more money from these short-term rentals. But here are three things to consider before you give AirBnB, or other short-term rental sites a try.

1. 30 DAYS OR LESS 

Most HOA’s won’t allow for a rental less than 30 days, but you should always check with your HOA. Having short-term rentals could potentially raise the insurance for your community, passing on these costs to all the homeowners. If you want to short-term rental but your HOA won’t allow, do your homework and present it to the board.

2. YOU COULD BE BREAKING CITY LAW 

Each city and each HOA is different when it comes to renting your home out for a short period of time. Irvine, Anaheim, Laguna Beach and San Clemente are grappling with short-term vacation rentals, with some considering anything less than 30 days a “hotel.” Dana Point only allows short-term rentals with a short-term rental permit. To save everyone time, check with your city before you approach your HOA.

3. NEIGHBORS DON’T FIND IT NEIGHBORLY 

Short-term rentals are sometimes people on a long business trip, or people ready to get in party vacation mode. We often hear of neighbors who are concerned about parties or lack of respect for community areas. If you are allowed to have short-term rentals, we encourage you to consider your neighbors and community.
